Job Summary
The Corporation Secretary and Manager Legal Services will oversee the legal and governance functions of the Authority. This includes offering legal advisory services, ensuring compliance with regulatory frameworks, providing secretarial services to the Board, and managing legal strategies to support the Authority’s mandate.

Key Responsibilities

  • Provide guidance to the Board on governance and compliance matters.
  • Develop Board Annual Work Plans and maintain governance documents such as committee charters and conflict of interest registers.
  • Review proposed national and county legislation affecting competition, consumer protection, and buyer power.
  • Draft and propose amendments to the Competition Act No. 12 of 2010.
  • Develop, review, and revise rules and guidelines under the Competition Act.
  • Formulate legal strategies for dispute management and oversee litigation functions.
  • Prepare legal documents including contracts, Memoranda of Understanding, and leases.
  • Engage with Parliament on matters affecting competition policy and legislation.
  • Support technical departments in settlement negotiations and hearing conferences.
  • Oversee the publication of Authority decisions and legal materials.
  • Advise on legal and corporate governance matters within the Authority.
  • Manage the implementation of departmental strategies aligned with the Authority’s Strategic Plan.
  • Drive operational efficiency in service delivery through technology and best practices.
  • Ensure compliance with governance codes and legal requirements.
  • Lead the development and execution of the department’s Strategic Plan.
  • Oversee the preparation and execution of the Authority’s service charter.
  • Manage departmental staff performance and continuous capacity building.

Operational Responsibilities

  • Monitor compliance with legal and regulatory requirements.
  • Provide secretarial services to the Board, including preparing and presenting Board Management papers.
  • Act as custodian of the Authority’s legal records, including Board minutes and policy documents.
  • Draft competition-related position papers for regional and international engagements.
  • Collaborate with legal stakeholders such as the Law Society of Kenya (LSK) and the Office of the Director of Public Prosecutions (ODPP).
  • Oversee the review of Notices of Investigation and Proposed Decisions from Technical Departments.
  • Identify procurement, training, and human resource needs within the department.
  • Manage business continuity and risk management strategies.
  • Ensure adherence to Quality Management Systems (QMS) and Information Security Management Systems (ISMS).
  • Address customer complaints, inquiries, and feedback concerning the legal department.
  • Oversee induction and mentorship of new departmental staff.

Qualifications and Experience

  • Academic Background: Bachelor of Laws (LL.B) degree from a recognized institution.
  • Postgraduate Training: Postgraduate Diploma in Law from the Kenya School of Law.
  • Professional Membership:
    • Advocate of the High Court of Kenya.
    • Member of the Law Society of Kenya (LSK).
    • Member of the Institute of Certified Secretaries of Kenya (ICPSK).
  • Advanced Studies: Master’s degree in Law or a relevant social science field from a recognized university.
  • Certification & Training: Valid practicing certificates and completion of a Management Course lasting not less than four (4) weeks.
  • Experience: Minimum of ten (10) years of relevant work experience, with at least three (3) years in a senior management role in a comparable public or private sector institution. Experience within a public institution is an added advantage.
