TEMPORARY ASSISTANT – INVESTIGATIONS (1 POSITION)
Contract Duration: Six (6) Months Fixed Term

Reporting To: Senior Manager – Investigations and Enforcement
Job Description
The successful candidate will assist the Authority in fulfilling its mandate on investigations and enforcement, particularly in ensuring compliance with laws and regulations governing Kenya’s capital markets. The responsibilities of the role are detailed below:
Key Duties and Responsibilities
- Assist in Investigating Market Manipulation and Abuse
- Support ongoing investigations into suspected activities related to market manipulation, insider trading, and other forms of market abuse.
- Gather and analyze data to establish patterns or irregularities that suggest unlawful activities.
- Collaborate with other enforcement agencies when needed.
- Forensic Investigations and Asset Tracing
- Engage in investigative procedures aimed at uncovering fraudulent schemes or illegal conduct.
- Help trace and recover assets obtained through illicit means.
- Contribute to developing comprehensive investigative reports with clear findings and recommendations.
- Facilitate Alternative Dispute Resolution (ADR) Mechanisms
- Participate in structured ADR sessions involving capital markets participants.
- Support the design and implementation of effective ADR frameworks to resolve conflicts outside the traditional legal system.
- Intelligence Gathering
- Conduct market surveillance and gather intelligence relevant to regulatory breaches or suspicious financial activity.
- Monitor reports, trends, and social media to identify potential threats to market integrity.
- Reporting and Updates
- Assist in the preparation of regular (monthly and quarterly) investigative updates for CMA management.
- Compile data for reports submitted to external bodies such as the Commission on Administrative Justice (CAJ).
- Policy Drafting and Legal Framework Review
- Contribute to the drafting of policies and guidelines aimed at enhancing the efficiency and transparency of CMA’s investigative processes.
- Review existing legal and regulatory frameworks to identify gaps or areas for enhancement to bolster investor protection.
- Support in Fit and Proper Assessments
- Aid in conducting background investigations as part of assessments to determine the suitability of individuals or firms for licensing or approval within capital markets.
Minimum Qualifications and Experience
- A Bachelor’s degree in one of the following disciplines:
- Law (LL. B)
- Criminology
- Accounting
- Bachelor of Arts
- Relevant Work Experience:
- At least one (1) year of relevant experience in an investigative environment will be considered an added advantage.
